It could happen, sometimes legitimate nudes are stolen and used in CSAM contexts. If that happens, the hashes could match. But I suspect it would be relatively rare, and hopefully the cops can tell the difference. (Emphasis on hopefully.)

A bigger problem might be that it seems really easy to trick perceptual hash models into not recognising a known fingerprinting. This might become common.
