That's an interesting line of reasoning — but I don't think you need agency to be tricked! The mechanism is being tricked, even if of course it's the designer who is cheated. I think that mechanism quality should matter to the designer/deployer's moral right wrt cheating.

If you protect your diary with a tiny padlock, it might not be prudent but your intent is still clear if I open it with a hairpin. If you protect it with a Rube Goldberg machine, maybe you meant for me to read it, who can tell?
