I only hear you as constructive, and I'm sorry if my attempt to engage constructively didn't work or worse backfired. I would prefer a different core message, but also might it not work better strategically?

"It's not the GDPR's fault" or points about ePrivacy feels like exactly the feedback they would expect, and is exactly where they thrive. Using a message they don't expect might carry more weight? I realise I'm saying this safely in bed in another country.
