I am not a lawyer, etc. but the law/regs indicate that if users pick a tool that's privacy-supportive, then it can be on by default. For Apple, well, that's on billboards all around the world. For Mozilla, they've been advertising their privacy too.
Both Chrome and Edge have been active in privacy, even if more recently. I got an ad about how Google care about privacy now this morning. They might have to prompt, but I think they could consider the default.
I would also add that Ethical Web and a couple of RFCs clearly document that privacy is an essential component of browsers. Browsers are meant to be PETs — that should count for something!
