I've seen advocates move to substantive prohibitions, but not much *against* opt-in. Unless we're extremely careful with consent, it tends to suck up all the energy and undermine the entire effect. See the NYS privacy bill, or worse the DMA!
I'm re-reading this part of the DMA, and frankly it makes no sense whatsoever. This kind of cross-context data sharing is bad for privacy and for competition. Competition is a *collective* issue — why allow the individualistic pathway that is consent to undermining it?
