Tricking is the inducement of false beliefs. You don't need agency, the most rudimentary information processing suffices. (To be clear: I'm not ascribing rights to the mechanism or any such nonsense.)

The way I read @rcalo's question (which might be off) was whether there are properties of the mechanism that make one trick OK & not the other. There might not be! In that case it's the same either way and we should get used to it like speeding trains & not stealing electricity.
